A licence is not required if the artworks are visible in the background of the video and are of minor importance in terms of the whole. This comes under the exception for ‘incidental use’. If, however, the artwork is the main subject of your film/picture and you use the image for purposes other than private ones, you need permission from the creator of the artwork for its use provided it is still protected by copyright.
