A direct link refers to a link that leads directly to the original page where the material is located. Students can watch videos in their own homes for educational purposes. The video linked should have been legally uploaded online.

Storing and making available AV material such as web videos, created by another person, on your own website requires the permission of the rightsholder. You are allowed to create direct links, so you can, for example, link to a YouTube video that has been legally uploaded online and is accessible to anyone. The creator of the video may also have allowed the video to be embedded on another website and may have made it available under a Creative Commons (CC) licence allowing various levels of open access and use. AV material includes all kinds of moving images, such as TV programmes, films, and web videos, e.g., YouTube videos.

Under the copyright exception for education, students may take recordings of music from the internet to use in course work provided the original creators and sources are acknowledged. The book trailer may be shown in class and saved in the school’s closed network where it is accessible to the teaching group and the teacher, but cannot be made available more widely without the permission of the original creators. The book trailer can also use music created by the students themselves, or music that can be freely used from the internet, such as content made available under a CC licence or material whose protection period has expired. Many video editing programs also have background music and sound effects that can be freely used. Check the usage rights for these in the program’s terms of use.

With ICLA’s copying licence, supported by an agreement with IVARO, a photograph found on the internet can be used for practising image editing for educational purposes. The image can, for example, be enhanced with an image-editing program. The edited image can be used in teaching situations within the students’ licensed school/college, but since the editing of any image is the exclusive right of its creator and requires the creator’s permission, it may not be shared online or used in other ways without separate permission. When copying and using the materials, the author and original publication must be acknowledged in the copy or material in accordance with the ICLA’s licence requirements.

Under copyright law, you may quote another person’s text to the extent justified by the purpose, provided that information about the author and the source is included according to good practice. The nature of the right to quote generally applies to use in scientific work, in supporting teaching, and when reviewing and criticizing other works. It is also possible to quote in other contexts. It is only permitted to quote a published work, i.e., a work that the author has made available to the public in some way. The quote must have a factual connection to the text in which it is used, fulfilling the so-called referencing function. The length of the quote or ‘extent justified by the purpose’ is not defined in the law and must always be determined on a case-by-case basis. Generally, a quote cannot be very long, but neither so short that it gives a false impression of the quoted work.

ICLA’s copying licence permits the copying of published text and still images within a licensed school/college for the purposes of education. In addition, the material copied can also be processed on a small scale – this includes editing, abridging and translating – to be used only in a specific teaching situation. When processing the material, remember to respect the author’s moral rights by acknowledging the author and source of the original material.

With ICLA’s copying licence, a teacher may use a wide variety of text materials for translation exercises as part of a course of study. The licence covers both domestic and foreign material thanks to reciprocal agreements with equivalent licensing bodies around the world. The licence permits the creation of translation exercises for educational purposes only, provided the author and source of the original material are acknowledged and the limits for amounts used are not exceeded (one article from a single magazine/journal issue/website; 5%/one chapter from a book). 

Under ICLA’s copying licence, a teacher can copy extracts from a textbook and include these in their own teaching materials provided these do not amount to more than 5% of the textbook’s content and the source is acknowledged. In principle, the use of images and their individual parts in a collage requires the creator’s permission. ICLA’s copying licence allows copying and use of images in teaching and in students’ exercises and school/college work provided the original creators and sources are acknowledged, and the work is not published or made available outside the teaching group.

ICLA’s copying licence allows a teacher to read a book aloud and display images from books or other materials in a distance learning situation, or with a recording of the lesson. A recording of the teaching situation may be made available to the teacher’s own teaching group in a closed learning environment.

Yes, a licence is needed to save or share copyrighted material for distance education. This ensures that the use of the material complies with copyright laws and the rights of the content creators are respected. However, the copyright exception for education allows recorded music and audiovisual material to be used for teaching purposes, including distance education, and text and still images can be used in this way under a school/college’s ICLA copying licence provided they adhere to its rules regarding size of extracts and acknowledging the original creator. For uses outside the exception and/or the ICLA licence, a school/college can seek permission directly from the copyright holder.
